1. Provider and scope
These Terms and License Conditions (“Terms”) govern access to nova-tweaks.com (the “Website”) and provide important information about the Nova Tweaks Windows application (the “Application”). The Application's GPL-covered software code is licensed separately under the GNU General Public License version 3 (“GPLv3”). If these Terms conflict with GPLv3 concerning GPL-covered material, GPLv3 controls.
The Services are provided by:
Elia Klemenz
Gernacher Straße 1
97509 Kolitzheim
Germany
Email: info@nova-tweaks.com
These Terms apply to consumers and businesses. Mandatory statutory rights, particularly mandatory consumer rights, remain unaffected.
2. Acceptance and legal capacity
By using the Website, you agree to the provisions of these Terms that govern the Website. You are not required to accept GPLv3 merely to receive or run an unmodified copy of the Application. However, permission to modify or distribute GPL-covered material is granted only under GPLv3, and exercising those permissions constitutes acceptance of GPLv3.
You must have the legal capacity required for any agreement you enter into. If you are a minor or otherwise have limited legal capacity, use the Website and Application only with the permission of your parent, legal guardian, or other authorised representative where required by law.
3. Description and availability of the Services
Nova Tweaks is a Windows system-tuning tool that provides documented settings, system-status information, backup and restore workflows, startup and application-management tools, performance-related controls, and other utilities described on the Website or in the applicable release notes.
The currently advertised version is provided free of charge, without an account or subscription. The Website does not provide a checkout or payment process. Voluntary support through a third-party platform does not purchase a licence, create premium rights, or entitle the supporter to additional features or services. Any refund for voluntary support is governed by mandatory law and the terms of the relevant third-party platform.
Feature descriptions, screenshots, performance examples, and roadmaps describe the relevant version at the time of publication. The release notes for a particular version determine its supported systems, included functions, and known limitations.
4. GNU GPLv3 software licence
Nova Tweaks is free software. Subject to GPLv3, you may run the unmodified Application for any purpose and may copy, study, modify, and distribute the GPL-covered software code, including modified versions and commercial distributions.
When you distribute GPL-covered source code or executable versions, you must comply with GPLv3. This includes preserving applicable copyright, licence, attribution, modification, and no-warranty notices; providing recipients with a copy of GPLv3; licensing covered modifications under GPLv3; and making the complete, machine-readable Corresponding Source available in the manner required by GPLv3.
The source code supplied for an executable release must correspond to that exact release and include the material and build or installation scripts required by GPLv3. The complete licence text is provided in the Application's LICENSE or COPYING file and is available at gnu.org/licenses/gpl-3.0.html.
5. Website rules and protection against misrepresentation
Nothing in this section restricts rights granted for GPL-covered material under GPLv3. When using the Website, you must not:
- attempt to compromise, overload, disrupt, or gain unauthorised access to the Website or its infrastructure;
- use the Website to distribute malware, violate applicable law, or infringe the rights of others;
- remove legal notices from Website content when reproducing material that you are otherwise lawfully permitted to reproduce; or
- misrepresent yourself or a modified distribution as the official Nova Tweaks project, or falsely suggest sponsorship, certification, or endorsement.
GPLv3 permits modified versions and requires them to be marked as modified. Separate trademark rules may require modified distributions to remove or replace Nova Tweaks branding where its use could cause confusion about origin or official status.
6. System changes and your responsibilities
The Application may request administrator privileges and may change Windows settings, the registry, services, scheduled tasks, startup entries, power settings, network settings, installed applications, or other system configuration when you deliberately select a corresponding action. These changes can affect stability, compatibility, security, energy consumption, network behaviour, hardware behaviour, or application functionality.
Before applying a change, you should read the description and risk information, check that the action is suitable for your device and intended use, save important data, and create an appropriate backup or restore point. You must have lawful authority to administer any affected device. The Application is not designed or tested for safety-critical, medical, emergency, industrial-control, or other systems where a malfunction could create a risk of serious harm.
You remain responsible for your Windows licence, device administration, security configuration, backups, third-party software licences, and compliance with policies that apply to a work, school, or managed device.
7. Performance and compatibility
System-tuning results depend on hardware, drivers, Windows version, firmware, installed software, workloads, configuration, and environmental conditions. We do not promise a specific frame-rate increase, latency reduction, benchmark result, power saving, or other performance improvement. A tweak that helps one system may have no effect or an adverse effect on another.
Compatibility information is provided in good faith for the versions identified in the relevant release notes. You should review Windows, driver, firmware, anti-cheat, game, and application requirements before making changes.
8. Updates, support, and discontinuation
We may provide updates, fixes, new features, compatibility changes, or documentation. Unless mandatory law requires otherwise, we do not promise a particular update schedule, response time, support period, or continued availability of any future version.
We may change or discontinue future availability of the Website, the Application, or individual features for legitimate reasons, including security, legal, technical, or operational reasons. This does not limit mandatory rights relating to a version already provided to you.
For security, we recommend obtaining the Application from the official release location linked by the Website. Where release signatures, publisher information, or checksums are supplied, verify them before installation. You are responsible for keeping Windows and security software reasonably up to date.
9. Our intellectual property
We retain copyright ownership in the original Nova Tweaks software code and other original materials. Copyright ownership is not transferred to users; instead, GPLv3 grants broad rights to use, copy, study, modify, and distribute GPL-covered material. Any visual design, interface code, graphics, or other material included within the GPL-covered work may be used to the extent permitted by GPLv3.
The Nova Tweaks name, logo, word marks, brand identifiers, and associated goodwill remain our exclusive property. GPLv3 does not grant trademark rights or permission to present a modified or third-party distribution as an official Nova Tweaks release. Truthful references to the project and uses permitted by applicable trademark law remain unaffected.
Separate Website editorial content, marketing copy, promotional images, and videos that are not expressly released under GPLv3 remain protected by copyright and may not be copied or reused except with our prior permission or as permitted by law.
Third-party names, trademarks, software, libraries, images, and other materials remain the property of their respective owners. References to third-party products do not imply affiliation or endorsement.
10. Feedback and suggestions
If you voluntarily provide ideas, suggestions, proposals, bug reports, feature requests, designs, or other feedback (“Feedback”), you confirm that you have the right to provide it and that it does not contain confidential information belonging to you or another person.
You grant us a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, and royalty-free licence to use, reproduce, modify, adapt, publish, translate, distribute, display, perform, combine, develop, commercialise, and otherwise exploit non-code Feedback for any purpose, including implementing it in the Services or other products. We may implement, modify, or decline Feedback at our discretion and have no obligation to credit or compensate you. This licence does not transfer ownership of pre-existing intellectual property that is merely referenced in the Feedback.
Unless a separate written contribution agreement states otherwise, source-code contributions intentionally submitted to the Nova Tweaks project are contributed under GPLv3. Contributors retain copyright in their contributions and must have the necessary rights to submit them.
11. Third-party services and open-source components
The Services may link to or interoperate with third-party websites, platforms, software, games, drivers, Windows components, or services. Those third parties operate under their own terms and privacy notices. We do not control their availability, content, security, or independent processing.
The Application may include third-party components governed by compatible licences. Their copyright and licence notices are supplied with the source code or distribution and govern those components where applicable. GPLv3 governs the combined covered work to the extent required. Nothing in these Terms restricts rights granted by GPLv3 or another applicable open-source licence.
12. Privacy
Our Privacy Policy explains how personal data is processed in connection with the Website, hosting, email contact, and optional YouTube activation. The Application is intended to operate without a website account; information stored locally by the Application remains subject to the documentation and settings of the applicable release.
13. Website suspension and GPLv3 termination
We may restrict access to infrastructure we control if you materially breach the Website rules, threaten the security or availability of the Website, use it unlawfully, or infringe the rights of others. Where appropriate and reasonably possible, we will first provide notice and an opportunity to remedy the breach.
Rights in GPL-covered material terminate only as provided by GPLv3, including its rules on reinstatement after certain violations are cured. These Website Terms do not revoke, narrow, or replace rights granted under GPLv3.
14. Statutory rights and warranty information
The Services are provided with the functions and characteristics described for the applicable version. We do not make guarantees unless they are expressly identified as guarantees in writing. Information on the Website does not constitute professional, technical, legal, medical, or financial advice.
Nothing in these Terms excludes or restricts statutory warranty, conformity, update, remedy, withdrawal, or other consumer rights where those rights apply and cannot lawfully be waived. Any exclusions or limitations in these Terms apply only to the extent permitted by applicable law.
15. Liability
We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body, or health, under an expressly assumed guarantee, in cases of fraudulent concealment, under the German Product Liability Act, and in all other cases where liability cannot lawfully be limited.
For damage caused by slight negligence, we are liable only where we breach an essential contractual obligation whose performance is necessary for the proper execution of the agreement and on which you may ordinarily rely. In that case, liability is limited to the damage that was foreseeable and typical when the agreement was concluded.
Subject to the preceding paragraphs, liability for slight negligence is excluded. Where liability for loss of data is limited, it is limited to the typical recovery cost that would have arisen if you had maintained reasonable and current backups. These limitations also apply for the benefit of our legal representatives and agents.
16. Changes to these Terms
We may update the Website Terms prospectively where necessary to reflect changes to the Website, security requirements, legal requirements, or our business. The updated version and its effective date will be published on this page. Where a change materially affects an existing contractual relationship and we have a direct means of contacting you, we will provide reasonable advance notice where required.
Changes do not apply retroactively and do not alter GPLv3 rights in a copy of the Application that you have already received. If you do not agree to updated Website Terms, you must stop using the Website; your use, modification, and distribution of GPL-covered software remain governed by GPLv3. Mandatory legal requirements concerning amendments remain unaffected.
17. Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of mandatory protections provided by the law of the country in which you habitually reside.
If you are a merchant, a legal entity under public law, or a special fund under public law, the courts with jurisdiction for our registered place of business have exclusive jurisdiction to the extent permitted by law. Otherwise, the statutory rules on jurisdiction apply.
18. Consumer dispute resolution
We do not participate in dispute-resolution proceedings before a consumer arbitration board and are not obliged to do so.
19. General provisions
If an individual provision of these Terms is invalid or unenforceable, the remaining provisions remain unaffected. The applicable statutory rule takes the place of the invalid or unenforceable provision. Failure to enforce a provision in an individual case does not waive the right to enforce it later.
GPLv3 is the controlling licence for GPL-covered Nova Tweaks software. Applicable third-party licence notices control their respective components. These Terms govern the Website and provide supplementary information without imposing further restrictions on GPL-covered rights. The English version is the original version.
